We made successful applications on behalf of our client, a Portuguese national, applications for leave to call further evidence, for an extension of time within which to apply for leave to appeal and for leave to appeal against a recommendation for deportation made by the Royal Court.

Our client had been sentenced to a term of imprisonment and his deportation had been recommended by the sentencing court.

Through a misunderstanding with the lawyer then acting for him (with whom he communicated through an interpreter), the recommendation for deportation was not originally opposed.

On the basis of the evidence that we put before the Court, it withdrew the recommendation for deportation, being satisfied that the offence was wholly out of character.  This was supported by his conduct in prison where he appeared to have been a model prisoner.
