We acted for the defendant in the first case where the issue of plea bargaining was considered by the Jersey superior courts.

Our client pleaded guilty to offences involving the proceeds of criminal conduct, contrary to the Drug Trafficking Offences (Jersey) Law 1988, on the basis of a bargain with the Crown under which it undertook to present reasoned conclusions to the court for a non-custodial sentence.

During the sentencing hearing, the Crown Advocate attempted to resile from this agreement and our client was sentenced by the Royal Court without the agreement being taken into account.
